In the 1997 settlement of Flores v. Reno, the federal government agreed to a variety of standards for the detention and release of unaccompanied minors in the custody of federal immigration officials. The settlement established state licensing authority for detention facilities. The Trump administration has proposed new rules that would withdraw the federal government from judicial oversight — and move detention-licensing authority from the states to the federal government — but keep some of the Flores settlement’s terms.
