Supreme Court Hears Appeal from Non-Unanimous Verdict

This week the Supreme Court heard oral arguments in an appeal from Louisiana that challenges earlier Supreme Court precedent upholding the states’ authority to allow non-unanimous guilty verdicts in criminal cases. The man appealing the case argues that the Sixth Amendment’s guarantee of a unanimous verdict should be incorporated via the Fourteenth Amendment to apply not only to federal juries but also to state juries (password required).
