Recent ACA Ruling Analyzed

Ilya Somin writes that last week’s ruling by a federal district court striking down  the Affordable Care Act has two bases: the 2017 tax law removed the ACA’s monetary penalty, and the mandate cannot be severed from the rest of the ACA. Somin agrees with the mandate aspect of the ruling, but contends that the court was “badly wrong” on the severability issue. Read more here.
