A group of scholars examine potential conflicts of law that are appearing among the states as the states take different paths on abortion rights in the wake of Dobbs. The right to travel is one such conflict. In this regard, the writers assert that “U.S. Supreme Court precedent and the very structure of federalism lead us to the conclusion that, if a state punishes its citizens for traveling to another state to procure an abortion after they have returned to the state, such a prosecution would indeed violate the right to travel.” Read more here.
