Steve Vladeck examines Ortiz v. United States, in which the Supreme Court offered an analysis of what kinds of military-law cases it will review. Vladeck writes that the Supreme Court is applying “federalism-like” principles to such reviews in that although Ortiz makes clear that the Court possesses the authority to review appeals from military courts, it prefers to treat the military court system like it treats the state courts. Vladeck argues that the Court should play a more active role in reviewing cases from the military-justice system. Read more here.
