Horizontal Federalism and the Big State “Problem”

Elizabeth Beske writes that horizontal federalism is both “poorly understood and increasingly important.” She suggests that the power of larger states to have a significant impact in interstate commerce is not a “problem” to be resolved by resorting to previously underutilized — in this context — clauses of the U.S. Constitution such as the Import-Export Clause or the Full Faith and Credit Clause.
