Federalism and the Scheduling of Marijuana

David Pozen and Matthew Lawrence contend that the existing federal drug-scheduling scheme does not work well for marijuana. They argue that a revised “managed market access” system would avoid both overcriminalization and corporate exploitation. They note that “in the best tradition of federalism, Congress can learn from state legalization strategies that have curbed public health risks while surviving constitutional challenges brought by industry actors.” Read more here.
