Federalism and Indirect State Extraterritorial Legislation

Jeffrey M. Schmitt notes that the recent U.S. Supreme Court case National Pork Producers Council v. Ross held that the dormant Commerce Clause does not guard against a state’s extraterritorial legislation. Schmitt contends that this type of  legislation, when it does not serve a legitimate state interest, should be unconstitutional because it violates federalism and state sovereignty.
