Doctrine Proposed to Address Abdication of Federal Responsibilities

Justin Weinstein-Tull writes that many states abdicate their federal responsibilities to local governments, then stifle local dissent to such action. This, he contends, has led to a patchwork of legal theories as courts struggle to address the issues resulting from this conduct. Weinstein-Tull proposes a “non-abdication doctrine” that he claims would provide a consistent way for courts to address abdication. Read more here.
