Do Local Exclusionary Zoning Laws Violate the U.S. Constitution?


Joshua Braver and Ilya Somin contend that exclusionary zoning by states and localities violates the Takings Clause of the Fifth Amendment. As part of this argument, they suggest that the 1926 U.S. Supreme Court decision that allows exclusionary zoning, Euclid v. Ambler Realty, should be overruled or sharply limited. Read more here.
