Cooperative Federalism in Energy Regulation

Joseph H. Margolies writes that two recent U.S. Supreme Court decisions have softened the jurisdictional boundary between the Federal Energy Regulatory Commission and state public utility commissions. The decisions have opened the door to cooperative federalism by creating a zone of concurrent jurisdiction.
