Blackbeard’s Wreckage Leads to State Sovereign Immunity Fight

A photographer who holds the exclusive right to film the salvage effort of a wreck off the North Carolina coast has sued the state, claiming that it used images created by him without permission. North Carolina has defended the copyright claim on grounds that the images are fair use and that states are immune from suit in federal court.
