Solidarity and Federalism

Erika Arban examines the scope of the principle of (federal) solidarity and its relationship with other doctrines such as Bundestreue, federal loyalty, and cooperative federalism. Arban argues that federal solidarity goes beyond altruism or philanthropy in that it suggests reciprocal duties among the parties involved. Arban goes on to assert that federal solidarity is implicit in, but not synonymous with, Bundestreue. She concludes that federal solidarity has both vertical and horizontal aspects, which, she argues, suggests that interesting applications could be developed for federal or otherwise decentralized systems.
